The most recent example? Organigram’s acquisition of Collective Project, a hemp beverage company with THC products already on shelves in the U.S. source. This follows on the heels of Green Thumb Industries (GTI), a U.S.-based company publicly traded in Canada, which acquired Agrify’s beverage division and the Senorita THC brand source.
Hemp Beverages as the Trojan Horse
These strategic acquisitions highlight a growing trend: Canadian cannabis companies are using Farm Bill-compliant intoxicating hemp beverages as a Trojan horse into U.S. markets. By leveraging legal loopholes that define hemp as cannabis with less than 0.3% delta-9 THC by dry weight, companies are able to sell intoxicating products outside of dispensaries. This low-friction, high-reach distribution model—enabled by e-commerce, alcohol distributors, and even convenience stores—is proving to be an attractive workaround for companies boxed out by U.S. federal prohibition.
Opportunity Knocks for Canadian Operators
For other Canadian cannabis companies watching these moves, the implications are significant. The U.S. THC drinks category is expanding rapidly, buoyed by a cultural shift toward "California sober" lifestyles and declining alcohol consumption. A recent MJBizDaily report noted that a major U.S. liquor retailer will soon offer THC drinks nationwide for 4/20. Combine that with bars in New York, Minnesota, and Texas now serving hemp-based THC cocktails alongside alcoholic drinks, and it becomes clear: the normalization of THC consumption is accelerating—far beyond the dispensary walls.
A Threat to State-Licensed Operators?
This trend creates a complicated competitive landscape for state-regulated cannabis operators. These businesses must comply with heavy taxation, strict advertising rules, and costly licensing requirements. Meanwhile, hemp beverage brands—often with comparable potency—can sidestep many of those regulations. This imbalance is already sparking frustration across the industry, with calls for more consistent policy enforcement. Without federal reform or state-level crackdowns, traditional cannabis companies could find themselves undercut by hemp startups with far fewer regulatory burdens and far greater distribution freedom.
What Big Beverage Might Do Next
The final twist? Big Alcohol and Big Beverage are watching closely. As consumer interest grows and regulatory clarity slowly improves, legacy beverage giants may be tempted to either acquire established hemp THC brands or launch their own. Some already are. Tilray, with deep roots in both cannabis and craft beer, is well-positioned to be a bridge between the two worlds. As hemp-derived THC beverages gain retail credibility, expect more partnerships, acquisitions, and brand launches from major players eager to stake a claim in this hybrid frontier.
